TERMS AND CONDITIONS FOR SPORTSWISE

The App is operated by Anthony Deldin (“I,” “me,” or “my”).By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.1. The ServiceSportsWise is a sports companion application that provides explanations of live sports plays and related educational content across multiple difficulty levels. The App offers some features for free, while other features require a paid subscription (“SportsWise Pro”).Explanations and information in the App are generated using automated systems, artificial intelligence services, and third-party sports data providers, and are provided for informational and entertainment purposes only. I do not guarantee the accuracy, completeness, or timeliness of any sports data, scores, or explanations.2. PrivacyYour use of the App is also governed by the SportsWise Privacy Policy, which explains how information is collected, used, and shared. By using the App, you acknowledge that you have reviewed the Privacy Policy. You can find it at https://privacy.sportswise.app.3. Eligibility and AgeYou must be at least 13 years of age (or the minimum age required in your country or region to consent to the use of online services) to use the App.
The App is not directed to children under 13. If you are between 13 and the age of majority in your jurisdiction, you may use the App only with the consent and supervision of a parent or legal guardian. By using the App, you represent that you meet these requirements.4. AI-Generated and Automated ContentThe App uses automated and artificial intelligence systems to generate explanations and other content. These systems may produce inaccurate, incomplete, delayed, or misleading outputs.You should not rely on the App as an official or authoritative source. In particular, the App is not intended for, and must not be used for: sports betting or wagering; fantasy sports decisions; official scoring or officiating; coaching decisions; medical, legal, or financial decisions; or any other professional, safety-critical, or high-stakes purpose. The App does not provide official rule interpretations.5. Subscriptions5.1 Subscription PlansSportsWise Pro is offered as an auto-renewable subscription:
• Monthly: $6.99 per month
• Annual: $39.99 per yearBoth plans include a 7-day free trial for new subscribers. Prices may vary by region and are subject to change. Any price change will apply only to future billing periods and will be communicated as required by applicable law and Apple’s policies.5.2 Free TrialIf you start a free trial, you will not be charged during the trial period. Unless you cancel at least 24 hours before the end of the trial, your subscription will automatically convert to a paid subscription and you will be charged the applicable price.5.3 Billing and Auto-RenewalPayment will be charged to your Apple ID account at confirmation of purchase. Your subscription automatically renews unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.5.4 Managing and Canceling Your SubscriptionYou can manage or cancel your subscription at any time through your Apple ID account settings (Settings → [your name] → Subscriptions on your device). Cancellation takes effect at the end of the current billing period. Deleting the App does not cancel your subscription.5.5 RefundsAll purchases are processed by Apple and are subject to Apple’s refund policies. I do not process payments and cannot issue refunds. Refund requests must be made through Apple. Except where required by law or as determined by Apple, payments are non-refundable.5.6 Apple TermsYour purchase and use of subscriptions may also be subject to Apple’s applicable terms, conditions, and policies (including Apple’s Media Services Terms and Conditions). To the extent any provision of these Terms conflicts with Apple’s applicable terms regarding payment, billing, cancellation, or refunds, Apple’s terms and policies control for use through the App Store.6. LicenseI grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms.7. Acceptable UseYou agree not to:
• Use the App for any unlawful purpose or in violation of any applicable laws;
• Attempt to reverse engineer, decompile, or extract the source code of the App;
• Interfere with or disrupt the App or its servers;
• Use automated systems to access the App, or send more requests than a human could reasonably produce;
• Scrape, harvest, or systematically extract data or content from the App;
• Share, resell, redistribute, or commercially exploit the App, your subscription, or its content.8. User-Submitted ContentIf you submit questions, feedback, text, or other content through the App, you are responsible for that content and represent that you have the right to submit it. You grant me a non-exclusive, worldwide, royalty-free license to use, process, display, and store that content as necessary to operate, improve, and provide the App, subject to the Privacy Policy. Do not submit content that is unlawful, infringing, or harmful.9. Intellectual PropertyThe App, including its design, text, graphics, and original content (excluding third-party sports data and user-submitted content), is owned by Anthony Deldin and is protected by intellectual property laws.All team names, league names, player names, logos, trademarks, and related identifiers are the property of their respective owners. Any use is for identification, commentary, educational, or informational purposes only and does not imply sponsorship, endorsement, affiliation, or approval. The App is not affiliated with, endorsed by, or sponsored by any sports league, team, player, or governing body.10. Third-Party Services and DataThe App relies on third-party services and data sources, including sports data providers, artificial intelligence services, analytics providers, and subscription-management providers. I am not responsible for the accuracy, availability, or content of third-party services. Your use of the App may be subject to the terms of those third parties.11. Changes to the AppI may add, remove, limit, modify, suspend, or discontinue features, sports, content, explanations, data sources, subscription benefits, or any part of the App at any time, subject to applicable law.12. DisclaimersTHE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. I DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY INFORMATION (INCLUDING SPORTS DATA, SCORES, AND EXPLANATIONS) WILL BE ACCURATE OR COMPLETE.13. Limitation of LiabilityTO THE MAXIMUM EXTENT PERMITTED BY LAW, ANTHONY DELDIN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. MY TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID (THROUGH APPLE FOR THE APP) IN THE TWELVE MONTHS PRECEDING THE CLAIM.14. Changes to These TermsI may update these Terms from time to time. Changes will be posted with an updated “Last updated” date. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.15. TerminationI may suspend or terminate your access to the App if I believe you have violated these Terms, used the App in a way that creates risk or liability, or if I discontinue the App or any part of it. You may stop using the App and cancel any subscription at any time. Upon termination, the license granted to you under these Terms ends.16. Governing Law and DisputesThese Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be brought exclusively in the state or federal courts located in Pennsylvania, and you consent to their jurisdiction.17.
